1 SUBJECT OF THE CONTRACT

The following terms and conditions apply to the ordering and sending of goods ordered by the customer via online shopping on the Internet via www.ourhood.rocks. The version of the GTC valid at the time of the conclusion of the contract shall be decisive. Deviating provisions of the contracting party, in particular counter-confirmations with reference to its terms and conditions, are hereby expressly contradicted.

2 CONCLUSION OF THE CONTRACT

All offers from OURHOOD are non-binding. The contract between the customer and OURHOOD comes about only by an order of the customer and its acceptance by the OURHOOD. The customer’s order is made online by completing the order form provided on the internet by OURHOOD. The OURHOOD accepts the order by sending a confirmation by e-mail to the customer by delivery of the ordered goods. We reserve the right to deviations from the illustrations and descriptions, weights, etc., and errors. If an item is sold out at the time of ordering, or is currently not available, it will be put in arrears and sent automatically after receipt of the goods. If no subsequent delivery is required, this must be stated in writing, stating the customer number. If goods are not deliverable by us within two months, the existing arrears will be canceled. If necessary, these items must be ordered again.

3 DELIVERY

Since we produce the goods we offer ourselves and are dependent on delivery times for required material, said delivery times are only valid for goods that are in stock. Delivery times for stock items are 1-5 days. For newly produced goods delivery times can be up to 4 weeks. We reserve the right to make partial deliveries, if this seems advantageous for a speedy settlement. In the case of a partial delivery, only the shipped part of the goods will be charged and payable at the usual conditions. Our obligation to deliver ends if the delivery of goods becomes impossible due to force majeure or other unforeseeable events. In these cases, as well as default of our suppliers, there are no claims for damages.

4 RETENTION OF TITLE

OURHOOD reserves the ownership of the purchased goods until the customer has completely paid the purchase price for the goods and all other goods from the same order.

5 PAYMENT / SHIPPING COSTS

(1) The customer can make the payment by bank transfer (prepayment) or by PayPal and has to provide sufficient coverage. Should a return be due to a shortage or incorrect data, additional bank charges will be charged to the customer.

(2) The delivery costs for each item vary depending on size and weight. The shipping costs incurred for your order will be displayed on the shopping cart page. Delivery outside Bulgaria is possible on request.

(3) In case of exercise of the right of withdrawal, the customer shall bear the regular cost of the return, if the delivered goods correspond to the ordered and if the price of the returned item does not exceed 100 euros or if you at a higher price of the thing at the time of withdrawal have not yet delivered the consideration or a contractually agreed partial payment. Otherwise, the return is free for you.

6 WARRANTY AND LIABILITY

(1) The warranty is based on the statutory provisions.

(2) Wood is a natural material, so deviations in color and irregularities in the structure are not grounds for complaint. It is important to us to see the natural surface of this natural material; In a few cases, this can sometimes include small cracks.

(3) OURHOOD reserves the right to a single right of improvement in the event of defective goods.

7 RIGHT OF WITHDRAWAL

The following cancellation policy is an integral part of the contract and only applies to end consumers. You can cancel your contract within 14 days without giving reasons in writing (eg letter, e-mail) or – if the case before the deadline – by returning the goods. The period begins on receipt of this instruction in writing, but not before fulfillment of our information obligations under Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations under § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB , To maintain the cancellation period, the timely dispatch of the revocation or the thing is sufficient.

Returns:

Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the thing, for us with their receipt.

§ 10 MISCELLANEOUS

Price changes, sales and errors excepted. For the business relationship German law applies. If the contractual partner is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction and place of fulfillment is our place of business for all claims arising from or based on a contract. The same applies to persons who have no general place of jurisdiction in Germany or persons who have relocated their place of residence or habitual residence outside of Germany after conclusion of the contract or whose domicile or habitual residence is not known at the time the complaint is filed.

All catalogs, brochures, lists, websites, databases and other documents in printed or electronic form created by OURHOOD are subject to our copyright, unless stated otherwise. Any use contrary to your intended function, reproduction, translation or storage in printed or electronic form is strictly prohibited! Exceptions require our express written permission and refer only to the documents mentioned in the license.

§ 12 FINAL PROVISIONS

(1) Should one or more provisions of these Terms and Conditions be ineffective, this does not entail the invalidity of the entire contract. The ineffective regulation will be replaced by the pertinent statutory regulation. An exception to this, however, is the case where a contracting party would be so unreasonably disadvantaged by the abolition of individual clauses that it can no longer be expected to be adhered to in the contract.

(2) This contract is governed exclusively by Bulgarian law, excluding the UN Sales Convention.

(3) Jurisdiction is Sofia, Bulgaria.
